General terms & conditions
1. Applicability
These general terms and conditions apply to all offers, services, and agreements between Navy or Grey and its clients, unless otherwise agreed in writing.
2. Tailor/custom services made-to-measure garment(s)
2.1 Appointments: Appointments for made-to-measure and/or custom garment(s) must be booked in advance by the client. Navy or Grey reserves the right to reschedule appointments due to unforeseen circumstances.
2.2 Payment means start of made-to-measure and/or custom garment(s): Once the client has paid the invoice in accordance with the payment terms as laid down in clause 5.1, then the order is confirmed and Navy or Grey starts the made-to-measure and/or custom process for the garment(s).
2.3 Expected delivery times: Made-to-measure and/or custom garments have an expected delivery window of four (4) to five (5) weeks. If fabric is unavailable, the order may be cancelled by Navy or Grey after notification of the client. Delivery times of made-to-measure and/or custom garments could be longer in case of force majeure or delays of fabric suppliers. The expected delivery times are only indicative and not binding.
2.4 Cancellation: Once production of a made-to-measure and/or custom garment has started for a client, orders cannot be cancelled by the client. In case of such cancellation, the client must notify Navy or Grey by e-mail info@navyorgrey.com and full costs are charged by Navy or Grey to the client. Navy or Grey reserves the right to cancel the made-to-measure and/or custom garment(s) due to unforeseen circumstances after notification to the client.
2.5 Returns: Made-to-measure and/or custom garments cannot be returned by the client to Navy or Grey nor refunded by Navy or Grey to the client.
2.6 Changes to custom garment(s): The services provided by Navy or Grey are tailored to the specific needs of each individual client with agreed rate(s), date(s), and locations. Once the made-to-measure and/or custom garment(s) process has started and the client delays or wants to make changes the made-to-measure and/or custom garment prior to finalisation of the garment(s), then these additional costs are borne by the client.
2.7 Shipping: Finalised and ready custom and/or made-to-measure garment(s) can be shipped directly by Navy or Grey to the client - at the client’s expenses - unless otherwise agreed between parties.
3. Personal shopper and/or stylist services
3.1 Appointments: Appointments for a personal shopper and/or stylist of Navy or Grey must be booked in advance by the client. To book an appointment with a personal shopper and/or stylist of Navy or Grey, the client can e-mail to info@navyorgrey.com.
3.2 Minimum hours: A personal shopper and/or stylist of Navy or Grey can be hired for a minimum of four (4) hours excluding travel time. Travel time and expenses are charged separately. The exact scope, duration, and fees will be outlined in a written proposal by Navy or Grey, to be approved and agreed by the client.
3.3 Services: The personal shopper and/or stylist of Navy or Grey can be hired to provide personal shopping and/or styling services to the client such as wardrobe consultations, accompanied shopping trips, styling advice and outfit planning, online shopping assistance, and other agreed services.
3.4 Cancellation: Cancellation must be communicated by the client by e-mail info@navyorgrey.com not later than 48 hours/two (2) days prior to the appointment date with the personal shopper and/or stylist of Navy or Grey. Cancellations by the client made between eight (8) days and 48 hours/two (2) days prior to the agreed appointment date, the client is obliged to pay 50% of the agreed rate - as written down and agreed - in the proposal. Cancellations within 48 hours prior to the agreed appointment or no-show of the client, the client incurs the full 100% fee. The personal shopper and/or stylist of Navy or Grey reserves the right to reschedule appointments due to unforeseen circumstances in consultation with the client.
4. Warranty
4.1 Warranty: Navy or Grey does not cover defects caused by misuse of the made-to-measure and/or custom the garment(s) by the client, alterations by a third-party, third-party dry cleaners and/or insufficient care.
4.2 Liability: Liability of Navy or Grey is limited to direct damage up to the invoice value, or Navy or Grey tailors a replacement of the damaged made-to-measure and/or custom garment(s). The client cannot invoke this liability towards Navy or Grey after six (6) months calculated as of the date of purchase as indicated on the invoice.
5. Payment terms
5.1 Payment terms made-to-measure and/or custom garment(s): Invoice(s) must be paid by the client in full once the client and Navy or Grey agreed on the made-to-measure and/or custom garment(s). Once the made-to-measure and/or custom garment(s) process has started and the client delays or wants to make changes the made-to-measure and/or custom garment prior to finalisation of the garment(s), then these additional costs are borne by the client.
5.2 Payment terms personal shopper and/or stylist: Personal shopper and/or stylist services provided by Navy or Grey to the client may be charged as hourly rates as agreed between parties. When the client has agreed to the proposal prepared by the personal shopper and/or stylist of Navy or Grey, then the client must pay the invoice in full and in advance. In case of any deviation and/or changes of the agreed services after approval of such proposal by the client, these additional costs are borne by the client.
6. Privacy & Data protection (GDPR)
6.1 Navy or Grey processes the client’s personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable Dutch privacy laws.
6.2 Personal information provided by clients (such as name, address, contact details, measurements, and style preferences) is used solely for the purpose of delivering our tailoring, styling and personal shopper services, fulfilling agreements, and maintaining client relationships.
6.3 Navy or Grey does not share personal information with third parties, unless required by law or necessary for fulfilling the service (e.g., fabric supplier or logistic partners).
6.4 Data is stored securely and retained only as long as necessary to provide our services or as required by law.
6.5 Clients have the right to access, correct, or request deletion of their personal data at any time by contacting us via info@navyorgrey.com.
6.6 Navy or Grey does not send newsletters or promotional emails without explicit consent.
7. Governing law
7.1 Governing law: These general terms and conditions of Navy or Grey are governed by Dutch law.
7.2 Dispute resolution: Any dispute arising from any of the services provided by Navy or Grey to the client will be resolved by the District Court of Amsterdam, the Netherlands.
